CLARIFICATION TEXT REGARDING THE PROTECTION OF PERSONAL DATA
This Clarification Text is intended to provide information about the practices regarding personal data under the responsibility of Binom Research and Consultancy Services Ltd. Şti (Binom Research), located at Akıncı Bayırı Sokak, Şişik İş Merkezi, No: 28 Kat: 2, Şişli/Istanbul, Turkey. It applies to all personal data obtained and processed as detailed below. BINOM RESEARCH reserves the right to update the content and scope of this text if necessary.
METHODS AND LEGAL BASIS FOR COLLECTION OF PERSONAL DATA
BINOM RESEARCH, as part of its commercial activities, requires personal data of individuals it engages with for market research, attitude and behavior studies, brand image and corporate image research, pre- and post-advertisement tests, communication and new product development insights, concept tests, packaging, naming, logo, and new product tests, needs and motivation research, barrier analysis, lifestyle and segmentation studies, satisfaction, expectation, and unmet needs research, trend studies, semiology, and various other types of research, statistics, analysis, and consultancy. These activities encompass sectors including but not limited to medical, telecommunications, banking and finance, FMCG, durable goods, automotive, retail, small household appliances, entertainment, media, fintech, energy, insurance, construction and real estate, and education.
The groups of individuals whose personal data may be processed include research participants, individual suppliers providing services such as survey interviewing, moderation, transcription, and translation, as well as individual consultants like lawyers and accountants, and clients. It also includes employees and shareholders of all business partners Binom engages with during its operations, visitors to Binom’s offices and studios, or job applicants (Other Related Persons).
Personal data of research participants may be provided directly by individuals on a voluntary basis or obtained through participant suppliers with prior consent for participation. This data can be collected through non-automated means such as face-to-face interview notes or filled forms, or automated methods such as web-based or online applications, responses entered into tablets by interviewers, audio and video recordings, or telephone interviews.
Similarly, personal data of other related persons may be collected directly from the individuals or from external sources such as the trade registry gazette, registration information, credit intelligence agencies, evaluation forms, information and record forms, order and payment instruction forms, and annexes of contracts such as tax plates, signature circulars, and copies of identity cards. This data can be collected via non-automated means or, to the extent permitted by law, through partially or fully automated methods such as email or web-based portals used by BINOM RESEARCH.
All personal data of the aforementioned groups may be collected where explicitly required by law, where directly necessary for the establishment or performance of a contract, where required for BINOM RESEARCH to fulfill its legal obligations such as notification, explanation, announcement, record-keeping, or retention, or where essential for the establishment, exercise, or protection of a legal right. BINOM RESEARCH also collects personal data as necessary for its legitimate interests as outlined in the purposes detailed below, taking care not to harm fundamental rights and freedoms. Publicly disclosed personal data may be processed by BINOM RESEARCH within the scope and purpose of its disclosure.
Personal data may also be collected and processed to the extent necessary to protect the life or physical integrity of an individual who cannot express their consent due to physical impossibility or whose consent is not legally valid.
PURPOSES OF PROCESSING PERSONAL DATA
Research Participants
The identity information of research participants, such as name, surname, and Turkish ID number, as well as contact information like phone numbers and addresses (for on-site research), are collected and processed to ensure the quality and reliability of the research. These include conducting necessary quality control and verification processes, resolving any deficiencies, errors, or discrepancies, preventing and detecting malicious acts such as abuse, fraud, or forgery, and issuing receipts or documentation for benefits or incentives provided in exchange for participation. These records are deleted from accessible systems and storage media after the completion of quality control, analysis, and reporting phases.
In addition, responses provided by participants, based on the subject and type of the research detailed above, are used and stored anonymously, without being matched with personal identification or contact information, for collective and cumulative analysis. These responses may occasionally include sensitive personal data, such as race, ethnicity, political opinions, philosophical beliefs, religion, sect, or other beliefs, clothing preferences, membership in associations, foundations, or trade unions, health, sexual life, criminal convictions, or security measures. Such data is processed only with the explicit consent of participants, and BINOM RESEARCH implements special security measures.
Other Related Persons
BINOM RESEARCH collects and processes personal data such as name, surname, Turkish ID number, copies of identity cards or driver’s licenses, contact information, professional and trade information, tax office details, tax ID numbers, invoice details, payment, debt, and collection information, and security camera records for visitors. This data is processed as part of BINOM RESEARCH’s legitimate trade and business purposes and other permitted uses under applicable laws. It is stored, viewed, analyzed, and used to the extent necessary.
The processing of personal data in this manner and for the legal reasons listed above serves purposes such as monitoring and managing production and manufacturing, marketing and sales processes, meeting service requests, managing satisfaction and complaints, procuring necessary products and services, ensuring physical, technical, financial, and commercial security, making payments, tracking collections, budgeting and financial planning, account management, auditing, reporting, resource management, planning, statistical and analytical studies, conducting internal administrative operations, and maintaining communication during business relationships.
THIRD PARTIES TO WHOM PERSONAL DATA MAY BE TRANSFERRED
Personal data may be shared in accordance with the legal grounds and purposes specified above, limited to and proportional with these purposes, and in all cases, within the scope permitted by applicable legislation. Where necessary, personal data may be shared with explicit consent, adhering strictly to the “need-to-know” principle.
Personal data of research participants may be shared with surveyors, moderators, or research teams authorized to carry out field research operations, and/or the business partners to whom they are affiliated, for the legal reasons listed above. Personal data of research participants is not shared with the organizations commissioning the research without explicit consent.
Personal data of other related persons may be shared with suppliers, consultants, subsidiaries, group companies, shareholders, or legally authorized institutions and organizations, within the scope of BINOM RESEARCH’s commercial activities. BINOM RESEARCH’s email service provider may operate on servers located abroad, dedicated solely to internal operations as detailed in this policy and clarification text.
YOUR RIGHTS REGARDING PERSONAL DATA
Under Article 11 of the Personal Data Protection Law No. 6698, you may:
- Learn whether your personal data is being processed,
- Request information about processed data,
- Learn the purposes of processing and whether it is used in accordance with these purposes,
- Learn to whom your personal data is transferred domestically or abroad,
- Request correction of incomplete or incorrect personal data,
- Request deletion, destruction, or anonymization of personal data upon the elimination of the purpose requiring processing and request notification of these actions to third parties to whom the data was transferred,
- Object to results obtained through automated processing that negatively affect you,
- Demand compensation for damages arising from unlawful processing.
To ensure your requests are processed appropriately, your application must include:
a) Full name and, if applicable, signature,
b) Turkish ID number for citizens or nationality, passport number, or ID number for foreigners,
c) Residential or workplace address for notifications,
d) If available, email address, phone number, or fax number for notifications,
e) A detailed description of your request.
Please include any relevant information and documents with your application to help us process your request effectively. We will respond to your application within the shortest reasonable time and no later than 30 (thirty) days from the date we receive it. Note that if the processing of your request incurs additional costs, a fee permitted by applicable legislation may be charged.
